It's a misdemeanor, and a second instrument lets the board go after the employment itself. Knowingly employing unlicensed or uncertified persons in the practice of nursing or nurse assisting is 1 of 8 things the act says no person shall do, so it reaches whoever does the hiring rather than only people the board licenses. The other 7 are practicing without a valid current license, certificate or temporary permit, except as otherwise permitted under the act or the Nurse Licensure Compact or the Advanced Practice Registered Nurse Compact; practicing under cover of a diploma, license, certificate or record illegally or fraudulently obtained, signed or issued unlawfully or under fraudulent representation; using words, abbreviations, figures, letters, titles, signs, cards or devices implying one of the 4 credentials unless the person holds it under the act or the APRN Compact or holds another state's license and practices here under the Nurse Licensure Compact; knowingly concealing information relating to violations; conducting a nursing education program for registered or practical nurses without board approval; otherwise violating or aiding and abetting a violation; and practicing while a license or certificate is suspended, revoked, surrendered, inactive or lapsed. A violation of any provision of the act is a misdemeanor carrying a fine of not more than $1,000, imprisonment for not more than 1 year, or both. That instrument is an injunction: the board may petition in its own name against any person, firm, corporation, institution or association employing an individual to practice nursing or nurse assisting who is not licensed, certified or exempted, and a court may find someone who breaches the injunction guilty of contempt. It carries no knowledge element, where the misdemeanor above it turns on the employer knowing.
