It fixes the ratios and points at the federal training regulation. Every course in the state offering certification has to meet 42 C.F.R. Ch. IV section 483.152, keep a student-to-teacher ratio no greater than 24 students to 1 registered nurse instructor for the classroom portion, keep a ratio no greater than 8 students to 1 registered nurse instructor for all clinical phases, or 8 students to 1 licensed practical nurse with at least 3 years of experience working under a registered nurse's supervision, and follow a curriculum complying with what the Department mandates by regulation. The instrument that sets the hours turns up twice more in the next section, once for the orientation of a nursing assistant and once for the orientation of a certified one. A third orientation runs on departmental guidelines instead: a certified nursing assistant placed by a temporary agency in a facility they haven't worked in for the previous 6 months gets a minimum of 2 hours before their first shift there.

The statute creates a course and a category of worker. The Board of Nursing approves the course, and the definitions give a name to anyone who has completed it, core course and any program specific specialized training modules included: LLAM trained unlicensed assistive personnel. That person may administer prescription or nonprescription medications in 5 settings the statute names: residential child care facilities and day treatment programs; residential or day services for persons with intellectual disabilities; group homes for persons with psychiatric disabilities, along with other community support programs certified by the Division of Substance Abuse and Mental Health; assisted living facilities; and group homes established for persons with AIDS. Nursing homes aren't on that list. Medications have to be in the original container and properly labeled, and an annual report goes to the Board of Nursing by August 1 each year on a form the board develops.

Delaware certification comes first. Reciprocity is how the Department grants it to someone certified elsewhere. The out-of-state program has to equal or exceed the federal nurse aide training requirements in 42 C.F.R. section 483.152, and the Department then asks a Delaware certified nursing assistant applicant for 4 things: a current certificate from the jurisdiction where the aide currently practices, good standing in that jurisdiction, the reciprocity fee with the application, and recent work. The experience condition is 3 months of full-time work within the last 24 months, which the rule puts at 420 clock hours of nursing related services for pay under the supervision of a nurse or physician, or else a training and competency evaluation program with at least as many hours as Delaware requires. 1 state is singled out by name: an applicant from Maryland has to hold a current Geriatric Nursing Assistant certificate. Either branch of the experience condition leads to the same certificate.
